The Icesave accounts were a private enterprise. The Icesave accounts were insured by security fund that was private as well. Furthermore it met the requirements of the EU directives, which also state that the system MUST NOT be guaranteed by state or official bodies.

 

Whatever commitments have been communicated between the Government of Iceland and the Governments of Britain and Netherlands they must not conflict with the EU directives and therefore not include a state or official guarantee of any kind.

 

Furthermore, in Iceland, it is only the parliament that has the authority to make financial commitments on the behalf of the state, which render any financial commitment made by the Government, with regard to state treasury, invalid.

 

It may have come to your attention that state guarantee for the insurance fund has already been trough the Parliament and as allowed for in our constitution the President of Iceland did not sign the law but referred them to a referendum. This essentially means that the matter has been referred to a democratic process relieving the Government of any commitments. According to the Icelandic constitution the sovereignty lies with the nation but not the parliament.

 

In June 2008 Lord Davies who is a assistant Minister in the Department of Finance in Britain said about the responsibility for the Icesave accounts in Britain: FSA (the British body for bank control/supervision) is responsible for the control/supervision of activities and cash position of branches of foreign banks in Britain (among them Icesave). The branches are subject to European directives. Furthermore FSA is consciously in communication with supervisory bodies in the domestic countries of the foreign branches in Britain. (Stop quote)
